GritXP Terms of Service

These Terms of Service (“Terms”) govern your use of the GritXP mobile application (the “App”) and any related websites and services (collectively, the “Service”), operated by Envaden LLC (“Envaden”, “we”, “us”, or “our”). By downloading, installing, or using GritXP, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

The Service is intended for users ages 13 and older. By using GritXP you confirm that you are at least 13 years old. If you are a parent or guardian and become aware that a user under 13 is using the Service on a device you control, please email info@envaden.com so we can help remove any associated data.

At launch, the Service is available in the United States only.

2. The Service

GritXP is a gamified skill-building app that gives you daily missions, arcade-style mini-games, and progress tracking (XP, levels, streaks, leaderboards). Your gameplay data is stored on your device. Certain optional features — including squad/league leaderboards, AI-powered coaching, and parent reports — send a limited set of information to our servers as described in our Privacy Policy.

We may change, suspend, or discontinue any part of the Service at any time. We will give reasonable advance notice in the app for material changes that affect existing paid subscribers.

3. Accounts

GritXP does not require you to create an account, register an email address, or provide your real name. Your callsign is the only public identifier other players may see in squads and leaderboards. You are responsible for choosing a callsign that complies with these Terms and our community standards (see Section 6).

 

4. GritXP Plus subscription

GritXP is free to download and use. Some features require an active GritXP Plus subscription, purchased through Apple’s in-app purchase system.

 

4.1 Pricing

  • GritXP Plus Monthly: $4.99 per month

  • GritXP Plus Annual: $29.99 per year

 

4.2 Free trial

New subscribers may receive a 7-day free trial as configured in the App Store. The trial begins when you confirm the purchase and ends 7 days later. If you do not cancel at least 24 hours before the trial ends, Apple will automatically charge your Apple ID at the subscription price.

 

4.3 Auto-renewal

GritXP Plus is an auto-renewing subscription. Payment is charged to your Apple ID at confirmation of purchase. The subscription automatically renews at the same price for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

 

4.4 Managing and cancelling

You can manage and cancel your subscription at any time in iOS Settings → [your name] → Subscriptions → GritXP Plus. Cancellation takes effect at the end of the current billing period; you retain Plus access until then.

 

4.5 Refunds

All purchases are made through Apple. Refund requests are handled by Apple in accordance with their policies; we are not able to issue refunds directly. You may request a refund at reportaproblem.apple.com.

 

4.6 Price changes

If we change subscription prices, we will notify you in advance through the App and through Apple. Continued use of GritXP Plus after a price change takes effect constitutes acceptance of the new price; you may cancel before the change takes effect to avoid the new price.

 

5. AI-powered features

Certain Plus features — including per-mission AI coaching, the in-app AI chat used in TOOL MASTERY and AI COLLAB missions, and the parent Mission Report — use a third-party AI model provider (Anthropic’s Claude API) accessed through our request proxy. By starting a GritXP Plus subscription or free trial:

  • You acknowledge that text you submit through these features will be transmitted in real time to our processor and to Anthropic to generate a response.

  • You acknowledge that AI-generated coaching is provided for educational and motivational purposes only. It is not professional, medical, psychological, educational, or legal advice and should not be relied on as a substitute for guidance from a qualified professional, parent, or guardian.

  • You agree not to submit confidential information about yourself or third parties, financial account numbers, government identification numbers, or content that violates Section 6.

AI features are not available on the free tier. No mission text or chat content from free-tier users is transmitted to Anthropic.

For minors aged 13–17, the start of any GritXP Plus subscription or free trial is authorized through the device’s Apple ID payment flow (typically requiring Face ID, Touch ID, password, or Apple Family Sharing parental approval). That payment authorization is the consent mechanism for any AI text processing under this Service.

6. Acceptable use

You agree not to:

  • Use a callsign or submit content that is hateful, harassing, sexually explicit, threatening, or otherwise inappropriate for a 13+ audience. We use an automated content guard at registration; we may additionally suspend or remove any callsign or account that, in our reasonable judgment, violates these Terms.

  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except to the extent applicable law expressly permits.

  • Probe, scan, or test the vulnerability of the Service or attempt to bypass any security or rate-limiting measure.

  • Use the Service to violate any law or third-party right, including intellectual-property and privacy rights.

  • Submit content you do not have the right to share, including content infringing on someone else’s copyright or other intellectual property.

  • Use the Service to develop a competing product or for commercial scraping of any kind.

We reserve the right to remove any content or restrict any user’s access if we reasonably believe these rules have been violated.

 

7. Your content

You retain ownership of the text, photos, voice notes, and journal entries you create in GritXP (“Your Content”). Your Content is stored on your device.

When a Plus feature transmits Your Content to our processor and Anthropic to generate a response (see Section 5 and the Privacy Policy), you grant Envaden LLC a limited, worldwide, non-exclusive, royalty-free license to process that content for the sole purpose of providing the requested feature. This license terminates when the response is generated; no copy is retained by us or by Anthropic after that point.

 

8. Our intellectual property

The App, its content (other than Your Content), its design, code, mission and quest text, the GritXP name and logo, and all associated trademarks are owned by Envaden LLC or its licensors and are protected by US and international intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on a device you own or control, for personal, non-commercial use, in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, or create derivative works of the App or its content, except as expressly allowed by these Terms or by applicable law.

 

9. Privacy

Your privacy is described in detail in the GritXP Privacy Policy, which is incorporated into these Terms by reference.

 

10. Third-party services

The Service relies on Apple (distribution and payment), Cloudflare (hosting), RevenueCat (subscription management), and Anthropic (AI provider). Your use of those underlying services is also subject to their respective terms. Envaden LLC is not responsible for the practices or content of third-party services beyond what is described in our Privacy Policy.

 

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any AI-generated response will be accurate, complete, current, or appropriate for any particular purpose.

 

12. Limitation of liability

To the maximum extent permitted by law, Envaden LLC and its officers, members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, lost data, or business interruption) arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for GritXP Plus in the 12 months preceding the claim, or (b) US $50.

Some jurisdictions do not allow certain disclaimers or limits on liability. Where law prohibits the limits above, our liability is limited to the smallest amount permitted by applicable law.

 

13. Indemnification

You agree to indemnify, defend, and hold harmless Envaden LLC, its officers, members, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your violation of these Terms, (b) Your Content, or (c) your violation of any law or third-party right.

 

14. Termination

You can terminate these Terms at any time by uninstalling the App. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

 

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and provide notice in the App. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

 

16. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The federal and state courts located in New Castle County, Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to the personal jurisdiction of those courts.

17. Apple-specific terms (App Store)

You acknowledge that these Terms are between you and Envaden LLC, not with Apple Inc. (“Apple”), and that Apple is not responsible for the Service or its content. To the extent these Terms conflict with Apple’s Media Services Terms, Apple’s terms govern but only with respect to your relationship with Apple. Apple is a third-party beneficiary of these Terms and may enforce them against you. You represent that you are not located in a country subject to a US Government embargo, and that you are not on any US Government list of prohibited or restricted parties.
